The China example: Notice 42 (2026)
In February 2026, the People's Bank of China and seven other agencies issued Notice 42 (People's Bank of China), replacing the 2021 notice. For individuals it means:
- crypto is not legal tender;
- crypto business is illegal financial activity, and offshore exchanges may not serve residents;
- civil acts from crypto investment against public order are void, and losses are your own;
- anything that amounts to a crime is prosecuted.
So individuals there have no legal protection: losses, scams or a counterparty who won't pay can't easily be recovered through the courts.
Is buying crypto on an exchange illegal?
Where crypto is legal, buying with your own money on a licensed exchange is legal and usually taxable when you sell. Where it's restricted, the usual position is “unprotected” rather than a crime in itself, but the rules decide, not the exchange.
Buying through P2P adds a risk everywhere: if the seller's account is linked to fraud, your payment may be investigated and your bank account frozen along with it.
Is selling USDT illegal?
Selling carries more risk than buying because money flows into your bank account:

Will my bank freeze my account for crypto?
Freezes depend on where the money came from, not which exchange you used:

To lower the risk: trade only with verified, high-volume merchants; make sure the payer's name matches the order; keep amounts and frequency modest; keep chat and order records. Don't use your salary or mortgage account for crypto.
Are big crypto profits legal?
Making money trading your own funds in your own account is not a crime in itself. Keep in mind:
- most countries tax crypto gains;
- where crypto is unprotected, disputes are hard to resolve;
- cashing out large sums brings the selling risks above;
